Forebearance Documents and Procedures

(1) Form of the execution version of the Notes Forbearance Agreement;
(2) The deed of accession;
(3) The Trustee notice.
(4) Non-disclosure Agreement

The noteholder should complete and execute:

i) the deed of accession (file: hkg1-204695-1.pdf) and deliver to ASAT; and
ii) complete the Trustee notice (hkg1-204778-2.pdf) and deliver it to the Trustee. Please also send a copy of both signed documents to OMM. You will find the contact address listed on page 6 of the forbearance agreement (1).

Please first send to ASAT the fax copy first and followed by the original signed copy by mail.

A non-disclosure agreement (3), is required to be executed should you wish to join the existing consenting holder group and the company in formulating the proposed restructuring plan.
